Data Deposit Conditions
By depositing data with BODC, you confirm that:
- You have read our Privacy notice.
- You are either the owner of the data or that you have obtained permission from the data owner to deposit the data. This is necessary to allow BODC to grant others the use of the data.
- You have agreed to the submission/storage of your personal data.
Licence
It is BODC policy for the ownership of the data to remain with the owner and that, by the act of depositing the data, you grant us a non-exclusive, perpetual licence to use and disseminate the data for all uses and re-uses, which may include commercial use. This licence includes the right to translate the data, without changing content, to any medium or format for the purpose of future preservation and accessibility.
Some of our funders are subject to the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIR), which means we are unable to respect all restriction requests.
BODC prefer to hold the data as “open” with no access or use constraints: what we term “Open Data”. Open Data will be made publicly accessible as part of BODC data holdings with an appropriate Open Government Licence “OGL” statement. If your data has any restrictions, you must justify these on deposition of the data. Some of our funders are subject to the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIR), which means we are unable to respect all restriction requests. Please note that under copyright law, BODC must restrict audiovisual data to academic access under fair dealing unless this has been addressed in the funders data policy or the copyright owner provides written agreement to waive the copyright.
If you would like to discuss deposit under another type of licence, please contact enquiries@bodc.ac.uk. If a copyright / acknowledgement statement is required, this can be added on deposit, although we cannot always guarantee this will appear with the data when re-use has been extended to third parties.
Responsibility for data deposited with/or re-used from BODC
BODC collects and preserves oceanographic data and information, making them available to a wide range of users and communities. BODC will hold the data ‘as is’ and Data will be make made it available to other users, alongside the relevant metadata provided to aid discoverability and re-use. Data supplied should be of good quality and accurate at the time of creation.
Privacy notice
In dealing with your data submissions, BODC will need to create a permanent, secure record of your contact details. The information will be used to enable BODC staff to contact you, should they have any questions about the data and/or metadata that you have supplied and to identify you as the data originator. Please see our privacy policy, for details on how we manage and process personal data.
We will take all reasonable precautions to protect your personal data from loss, misuse or alteration and only authorised BODC employees will have access to the information. Your name and organisation may be supplied to subsequent users of your data, to identify you as the data originator, so that you can be properly acknowledged or discuss co-authorship requirements with data users.
